How to Request a DOL Hearing After a Spokane DUI

You have seven days, not 20, to request a DOL hearing after receiving a Spokane DUI-related license notice. A criminal court date doesn’t preserve your driving privileges or count as a hearing request with the Washington State Department of Licensing.

The licensing process runs on its own timeline under Washington’s implied-consent law, RCW 46.20.308. Any related DUI charges proceed separately through the criminal courts.

The Seven-Day DOL Hearing Request Deadline

As of November 4, 2026, Washington drivers generally have seven days from notice of a DUI-related license suspension, revocation, or denial to submit a written hearing request to the DOL.

Older information may still refer to a 20-day deadline, but that rule changed in 2019. Waiting for a Spokane court appearance, arraignment, or criminal case update can cause the licensing deadline to pass. Identify the starting date based on how notice was given:

  • Notice Given After Arrest: When an officer provides the required notice at or following an arrest, count from the date it was given.
  • Mailed Request: A request sent by mail must be postmarked no later than the seventh day after you receive the notice.
  • Blood Test Notice: If the DOL provides notice following a blood test, the request period begins when that notice is given, not on the arrest date.

The effective date also matters. Unless a hearing decision occurs sooner, a license action generally begins on the 30th day following the arrest or, in a blood-test matter, the notice. Keep the notice with your arrest paperwork and record both dates.

Complete the Request for DUI Hearing Form

A timely request requires more than a statement that you want to challenge the suspension. The DOL uses a document called the Request for DUI Hearing form.

The notice and related arrest paperwork identify the action involved and the applicable deadline. Review each document before submitting the form, then retain a copy of the completed request and proof of when it was submitted or mailed.

Hearing Fee
Washington law requires a $375 hearing fee with the request. The DOL may waive the fee for a driver found indigent whose income is below the federal poverty threshold.

Address a fee-waiver request promptly if the fee is a barrier. It doesn’t extend the seven-day deadline, so submit the request and any required financial information during the same short window.

What the DOL Hearing Decides

A DOL hearing addresses the state’s proposed licensing action, not criminal guilt. It remains separate from the DUI case proceeding through the court system.

An administrative law judge reviews a limited set of issues. Depending on the case, these include whether the arrest was lawful, whether the officer had reasonable grounds, whether the required implied-consent warnings were provided, and whether a test was refused or showed a disqualifying alcohol or THC concentration.

At the hearing, you have these procedural rights:

  • You may be represented by counsel.
  • You may question witnesses, present evidence, and testify.
  • The administrative law judge decides whether to sustain or rescind the licensing action based on the issues within the hearing’s scope.

The hearing doesn’t replace the criminal case, resolve every question about the traffic stop, or determine all consequences connected to the arrest. Its records and testimony may still warrant review while the criminal case develops.

Plan for the License Action & Driving Options

Requesting a hearing gives the DOL an opportunity to review the proposed action. The request doesn’t, by itself, authorize unrestricted driving beyond the stated effective date.

After the DOL receives a timely request, the hearing generally must occur within 30 days, excluding Saturdays, Sundays, and legal holidays, unless both sides agree to a different schedule. Watch for the hearing notice and arrange to attend.

Ignition Interlock Driver’s License
An ignition interlock driver’s license permits driving a vehicle equipped with an ignition interlock device. A driver may apply after receiving an implied-consent notice or following a suspension, revocation, or denial, subject to installation and financial-responsibility requirements.

Driving without confirming your current license status creates unnecessary risk. Before relying on a restricted driving option, verify its conditions and the date the proposed DOL action takes effect.

Track Hearing, Appeal & Criminal Court Deadlines

Review the administrative process and criminal case together while recognizing that they remain separate proceedings. The DOL record may include the officer’s reports, testing information, and licensing documentation, while the criminal case involves the state’s prosecution and its own court deadlines.

If you miss a scheduled hearing, you may request that a default order be vacated within seven days of the administrative law judge’s decision by submitting a written explanation for your absence. If the decision sustains the action, you may appeal by petitioning Superior Court in the county of arrest within 30 days after service of the final order. The DOL charges a separate, nonrefundable $40 administrative-record preparation fee for the appeal.

The practical sequence is straightforward: meet the hearing-request deadline, track the effective date of the license action, and prepare independently for the criminal case.
